I'd suggest that it's a sub prime sub contracted part that's been scrutinised by BMW and found to be failing.

Wanting to avoid another scandal al la Volkswagen they've jumped on it and dealt with it in a professional but over zealous fashion.

Probably won't stop the US or the FTC from still going after them but at least they can show, hopefully, that they took action as soon as they were aware unlike Volkswagen who intentionally cheated.

They have all been fined but nowhere near as much as VW.
